WAIVER AND RELEASE

STATEMENT AND RELEASE TO BE READ AND SIGNED PRIOR TO TAKING PART IN INFINITY, beyond fitness outdoor exercise class

In consideration of my participation in the INFINITY, beyond fitness outdoor out class (the “Class”), the below

undersigned acknowledges, appreciates, and agrees that:

Participation in the Class involves physical activity and risks of physical injury, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

1) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation;

2) I hereby affirm and attest that I have not been advised by my physician not to engage in the exercises which I will perform during the Class;

3) I hereby consent to emergency transportation and treatment in the event of illness or injury. I hereby accept responsibility for the payment of any emergency transportation or treatment;

4) I hereby acknowledge that COVID-19 is a highly communicable virus that can cause severe adverse medical conditions, including death, for those who contract it. I further acknowledge that by participating in the Class referenced herein, I am knowingly and willingly assuming the risk that I may by exposed to or contract COVID-19;

5) I hereby agree to abide by all safety rules, directives, directions and protocols adopted by INFINITY in advance of and throughout the duration of the Class referenced herein;

6) I hereby agree to adhere to the state and local, as well as any and all local COVID-19 safety requirements;

7) I hereby affirm that I am not currently experiencing any of the symptoms that are listed on the CDC health and information website and that I have not experienced similar symptoms in the last 14 days;

8) I hereby affirm that I have not been exposed to any third parties, including members of my household who has a confirmed or suspected COVID-19 diagnosis.

9) I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release and hold harmless IBF Cocowalk, LLC, d/b/a INFINITY, beyond fitness (the “Company”). and its parents and affiliates and each of their directors, officers, officials, agents, employees, and volunteers  and any talent, 

instructors, hosts, vendors or brand partners ("Releasees"), with respect to any and all injury, disability, death, or loss or damage to person or property incident to my involvement or participation in these programs,

whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

10) I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, hereby indemnify and hold harmless all the above Releasees from any and all liabilities incident to my involvement or participation in the Class, even if arising from their negligence, to the fullest extent permitted by law; and

11) I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, hereby voluntarily waive any right I may have to a trial by jury in any action, proceeding or litigation involving the Releasees.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
